Know Your Rights: Abortion Services

**Disclaimer: (January 2025) As we work to adapt this project to the realities of a new presidential administration, please be aware that some of the Federal resources listed here, such as the HHS ReproductiveRights.gov website, have already been removed, will soon be removed, or may be altered to contain misleading, biased anti-abortion information. Please be vigilant if you are utilizing these Federal resources in the coming weeks, and reach out to us at ReproductiveFreedom.Caucus@mail.house.gov if you need assistance or would like to connect with a local Member of our Caucus. We will be back with additional details as soon as possible.**

Since Roe v. Wade was overturned in June 2022, abortion laws and access to care have varied substantially from state to state. New York has long taken steps to safeguard abortion rights and protect access to reproductive health care. Abortion has been legal in New York since 1970 – and remains legal even after the Dobbs ruling.

In New York, abortion services are entirely confidential. You have the legal right to healthcare privacy, including the right to confidentially choose safe abortion care, to choose or refuse birth control, and to access reproductive health care, free from harassment and discrimination.

Abortion care is health care. Reproductive rights are human rights. You and all New Yorkers deserve the freedom to make your own medical decisions – including about abortion.

Please review the resources below for information on Congressional action being taken to advance reproductive freedom, your rights, and accessing care in New York.

What I Am Doing

Congressional Pro-Choice Caucus

In the 118th Congress, I am proud to be a member of the Congressional Pro-Choice Caucus (PCC) – a group of over 150 Members of the U.S. House of Representatives committed to advancing reproductive rights, freedom, and justice.

From moving key legislation forward to amplifying the voices of those in NY-10 and around the country demanding action, I consistently stand with my PCC colleagues as we fight for your reproductive freedom and bodily autonomy.

You can learn more about the PCC here.

Legislation

Whether we are in the majority or minority, my Democratic colleagues in Congress and I are constantly working to advance bills that safeguard your reproductive rights, protect your private health care data, expand access to care, and reaffirm U.S. commitment to global health and human rights worldwide, among other key issues. Read more about those initiatives here:

Abortion Rights

The right to abortion must be safeguarded in federal law. That is why I am a proud cosponsor of the Women’s Health Protection Act which would enshrine the right to an abortion in federal law. I was also proud to sign the Pro-Choice Caucus’ discharge petition which is only seven signatures away from forcing a vote on the House Floor on this critical bill, even over GOP leadership objections.

I strongly support the Ensuring Women’s Right to Reproductive Freedom Act, which would protect the right to travel between states for reproductive health care, and I’m fighting to remove the ratification deadline for the Equal Rights Amendment, so that we can finally to enshrine gender equality in the U.S. constitution.

I also joined amicus briefs to both the U.S. Court of Appeals for the Fifth Circuit and the Supreme Court to protect American’s access to the oral abortion medication Mifepristone.

Contraception Rights

You, and only you, have the right to decide whether, how, and when you become a parent. Every person deserves that autonomy– and deserves to be able to choose the method of birth control that works best for them, free from political interference. As extreme GOP attacks on contraception are already taking place across the nation, I am proud to stand with 9 in 10 Americans and support the bipartisan Right to Contraception Act. This bill would enshrine the right to contraception into federal law and prevent attempts to restrict access to birth control.

Access to Abortion

In addition to protecting the right to abortion, true reproductive freedom means every person must have access to the reproductive health care they need, regardless of income, insurance, or zip code. This requires decisive action to abolish harmful and discriminatory restrictions, such as the Hyde Amendment – a policy that prevents those who rely on Medicare, Medicaid, or other government sponsored health insurance from obtaining abortion care. This predominantly impacts poor women and women of color. House Democrats are working to eliminate the Hyde Amendment once and for all and ensuring everyone is able to obtain abortion care. This is why I am proud to be a cosponsor of the Equal Access to Abortion Coverage in Health Insurance (EACH) Act, to help ensure that all Americans can access the full spectrum of health care, including abortion care, regardless of their income or the source of their insurance.

My colleagues and I are also working to advance the Protecting Reproductive Freedom Act, to reaffirm the FDA’s authority over medication abortion approval and keep medication abortion accessible for all.

Data Privacy

Your reproductive health care choices should be between you and your health care provider.

That information should never be publicized against your will or weaponized. We must protect personal reproductive health data which is why I am proud to support the My Body, My Data Act to create a new national standard for protecting the privacy of personal reproductive and sexual health information.

Avoid Fake Clinics aka “Pregnancy Crisis Centers”

Unfortunately, there are anti-choice, anti-abortion propaganda centers that oftentimes masquerade as “pregnancy crisis centers” or “pregnancy resource centers”. They intentionally place themselves near legitimate health clinics and abortion facilities hoping to confuse or attract women. In many cases, these centers don’t employ licensed or certified health care professionals and instead, exploit moments of acute vulnerability to push their extreme religious and political views. Dangerously, because these centers are not medical clinics, they do not always give out accurate medical advice and don’t have to adhere to the strict data and privacy rules outlined in HIPPA.

According to Planned Parenthood, you can look out for the following signs that a clinic might be a crisis pregnancy center:

  • It’s listed online or on map apps as a pregnancy resource center, pregnancy help center, pregnancy care center, women’s resource center, or abortion alternatives.
  • They advertise free pregnancy tests, abortion counseling, pre-abortion screenings, abortion education, post-abortion care, or after-abortion help — but they refuse to help you get an abortion.
  • They advertise “abortion pill reversal” or say you can “reverse” an abortion. (This isn’t true — you can’t reverse an abortion.)
  • They say abortion is unsafe, or that it leads to cancer, infertility, or mental health problems. (This isn’t true — abortion is one of the safest medical procedures. The rate of major complications is less than 1%, and it's safer than getting your wisdom teeth taken out. Abortion also doesn’t increase your risk for cancer, infertility, or mental health problems.)
  • They try to talk about religion even when you don't want to.
