Congressman Dan Goldman Demands Answers from Sole Commercial Supplier of Mifepristone on Plan Not to Distribute Abortion Medication to 31 States
Congressman Goldman Calls for Transparency from Sole Distributor of Mifeprex, AmerisourceBergen
List Includes States Where Medication Abortion Remains Legal
Washington, DC – Congressman Dan Goldman (NY-10) yesterday joined the Democratic Women’s Caucus (DWC) in sending a letter to AmerisourceBergen CEO Steven Collis urging him to provide a clear rationale behind the decision not to distribute Mifeprex in 31 states across the country. AmerisourceBergen is the sole supplier of Mifeprex, the brand name mifepristone, which is a commonly used abortion medication used around the country. AmerisourceBergen’s list includes states were abortion remains legal.
“If this reporting is accurate, it is unconscionable that AmerisourceBergen has caved to political pressure from extremist Republicans and plans to endanger the lives of women across the country,” Congressman Dan Goldman said. “We cannot allow activist judges and extreme Republican state legislatures to exchange their political opinions for the expertise of the FDA, and AmerisourceBergen has an obligation to abide by the law, not the whims of political extremists. Mifepristone has been used safely for abortions for decades and without access to this vital medication, hundreds of thousands of women will be cut off from abortion access.”
Despite AmerisourceBergen’s critical role in ensuring women have access to medication abortion, recent reporting from Vox revealed that they circulated a list to corporate clients of 31 states where it would not supply medication abortion to certified pharmacies.
Further reporting from Politico revealed that said list even included Nevada, a state with numerous laws protecting the right to abortion and to prescribe and use medication abortion. Despite this reporting, AmerisourceBergen has yet to share its list publicly, or to Members of Congress.

We write today because we are concerned about reports that AmerisourceBergen will not distribute Mifeprex to certified pharmacies in 31 states. As the sole distributor of Mifeprex in the United States, AmerisourceBergen’s actions could be the determining factor in whether a patient has access to a safe, effective medication needed for an abortion through a certified pharmacy.
To that end, we request you provide Members of Congress the full list of states and jurisdictions where you intend to not distribute Mifeprex and clearly outline the determination process and the rationale used to develop that list. If you are unable or unwilling to provide a list, we request that you provide clear steps on how Members of Congress can access this information about their state from AmerisourceBergen.
