Congressman Dan Goldman Fights to End Immunity for Gun Manufacturers and Hold Them Accountable for Contributing to Gun Violence Epidemic

Washington D.C. – Congressman Dan Goldman (NY-10) joined Congressman Adam Schiff (CA-30) to introduce the ‘Equal Justice for Victims of Gun Violence Act,’ which would repeal the Protection of Lawful Commerce in Arms Act (PLCAA). The PLCAA, passed by Congress in 2005, has protected gun manufacturers from lawsuits and undermined the admissibility of gun trace information in civil proceedings. Historically, firearms manufacturers, sellers, and interest groups have relied on provisions in the PLCAA to shield them from civil liability, leaving countless gun violence victims and survivors without a path to recourse through the justice system.
The ‘Equal Justice for Victims of Gun Violence Act’ would not only ensure that victims of gun violence have their day in court, but that negligent gun manufacturers are held liable when they disregard public safety, and that gun trace data can be accepted as evidence in court.
“Gun manufacturers cannot be allowed to freely and intentionally flood our streets with weapons of war without consequences,” Congressman Dan Goldman said. “For nearly two decades, victims of gun violence have had no legal recourse against the companies that sell these dangerous weapons in our communities. If we are going to truly fight to end the scourge of gun violence in this country, we must hold gun manufacturers accountable.”
Congressman Dan Goldman is committed to protecting communities across the country from the dangers of gun violence.
In October, the Congressman joined with fellow leadership members of the Gun Violence Prevention Task Force to condemn the Republican failure to respond to the gun violence epidemic, as well as joining the Task Force in a letter urging Speaker Johnson to use his new authority to bring bipartisan, commonsense gun safety legislation to the floor for a vote.
Last month, Congressman Goldman cosponsored the ‘Responsible Firearms Marketing Act,’ which would direct the Federal Trade Commission (FTC) to study the dangers of unfair and deceptive marketing and advertising practices utilized by the gun industry.
Congressman Goldman is a Vice Chair of the House Gun Violence Prevention Task Force and was recently named as Chair of the Dads Caucus Gun Violence Prevention Working Group.
